A Settlement has been reached in a class action lawsuit about whether Posh Group, Inc. (“Defendant”) sent marketing text messages to telephone numbers after being asked to stop in violation of the Telephone Consumer Protection Act (“TCPA”). Defendant denies the allegations and any wrongdoing. The Court has not decided who is right.

Current Status
The proposed Settlement provides the following:
- The Settlement includes all persons within the United States who, within the four years prior to the filing of this Complaint, (1) were sent a text message from Defendant or anyone on Defendant’s behalf, (2) regarding Defendant’s goods, products or services, (3) to said person’s residential telephone number, (4) after making a request to Defendant to not receive future text messages.
- The Settlement offers payments to Settlement Class Members who file valid Claims.
- Class Members may ask to be excluded, or object.
- The Court has scheduled a Fairness Hearing for August 25, 2025. At this hearing, the Court will consider whether the Settlement is fair, reasonable, and adequate. The Court will also consider the requests by Class Counsel for attorneys’ fees and expenses and for a Service Award to the Class Representative. If there are objections, the Court will consider them at that time. After the hearing, the Court will decide whether to approve the Settlement.
